Unified Patent Court One Step Closer after UK Ratification

In a significant development for international patent litigation, on 26 April 2018, the UK announced its ratification of the Unified Patent Court Agreement (“UPCA”). If implemented, this will create an international court with jurisdiction over patent disputes across its contracting states, enabling a single judgment in cross-border disputes.

Attention will now turn to Germany, which must also ratify the UPCA before it comes into effect. The German Constitutional Court is due to hear a constitutional complaint over the UPC later this year, which remains a potential stumbling block.
