Financial Provision on Divorce - Law Commission consultation extended

The Government tasked the Law Commission with reviewing the law in relation to pre nuptial and nuptial agreements some time ago.

That lengthy review has now been extended to consider ways to create more certainty about the financial outcomes on divorce.  The Law Commission is to consider two keys areas, namely the way non-marital assets are treated (e.g. inherited assets, or assets acquired after marital breakdown), and the extent to which one party should  be expected meet the other's needs after divorce.

The hope is that the Law Commission's final report will lead to changes that will create more certain outcomes for divorcing couples.
