HYBRID MEDIATION ON SEPARATION AND DIVORCE

The family department at Stevens & Bolton can, in most cases, offer clients a fixed fee for their divorce.

The divorce costs are separate to those for dealing with any financial or children matters.

For the petitioner included in the fixed fee are the following:

  • Preparing the divorce petition
  • Advice in relation to the respondent's acknowledgement of service
  • Preparing the petitioner's statement in support of their petition and application for decree nisi
  • Preparing the application for decree absolute, which dissolves the marriage
  • Advice in relation to the divorce and corresponding with the respondent's solicitors and the court in relation to the divorce

This fixed fee is on the basis that there are no unforeseen delays or complications. We reserve the right to charge for any extra unforeseen work incurred at our usual hourly rates. There will be additional costs in any of the following circumstances:

  • If the petitioner includes a claim in their divorce petition for the respondent to pay their divorce costs and a dispute arises on this issue
  • If there are difficulties serving the divorce petition on the respondent
  • If the respondent defends the divorce or prepares a cross-petition

For the respondent included in the fixed fee are the following:

  • Advice in relation to the petitioner's divorce petition
  • Completing the acknowledgement of service
  • Advice in relation to the divorce and corresponding with the petitioner's solicitors and the court in relation to the divorce

This fixed fee is agreed on the basis that there are no unforeseen delays or complications. We reserve the right to charge for any extra unforeseen work incurred at our usual hourly rates. There will be additional costs in any of the following circumstances:

  • If the petitioner includes a claim in their petition for the respondent to pay their divorce costs and a dispute arises on this issue
  • If the respondent defends the divorce or prepares a cross-petition
  • If the respondent applies for decree absolute

At present we are also able to offer a service involving the online submission of divorce petitions. This is currently a pilot project we are engaging in with HMCTS and is not suitable for all cases. Online submission of the petition can significantly expedite the process. Your lawyer will discuss this with you.
